Man Pleads Guilty to Possession of Child Porn

United States Attorney Marty J. Jackley announced today that on October 20, 2006, Carl Smith pleaded guilty in federal court to possession of child pornography. Smith (37), of Fargo, North Dakota, appeared before U.S. District Judge John E. Simko and pled guilty to the original indictment which was returned following an investigation conducted by the Federal Bureau of Investigation. The maximum penalty upon conviction is ten years imprisonment and/or a $250,000 fine. Jackley said the charges relate to incidents between January 1, 2005, and August 12, 2005, wherein Smith possessed computer files that contained child pornography. The case was prosecuted by Assistant United States Attorney Gregg S. Peterman. A presentence investigation was ordered and a sentencing date will be set.
