United States Attorney Marty J. Jackley announced today that on
November 14, 2007, Adam Tobacco, age 21, of Oglala, was sentenced
by U.S. District Judge Richard H. Battey to fifty-five months incarceration,
three years supervised release, and ordered to pay $100 to the
Victim's Assistance Fund. Tobacco was originally indicted by a
federal grand jury in May 2007 for sexual abuse of a minor following
an investigation conducted by the FBI and the BIA. The charges
stem from an incident on April 30, 2005, that occurred near Oglala,
when the defendant attempted to engage in a sexual act with a person
who was between the ages of 12 and 16. On August 28, 2007, Tobacco
pled guilty to sexual abuse of a minor. This case was prosecuted
by Assistant United States Attorney Gregg S. Peterman.
