United States Attorney Marty J. Jackley announced today that on January 9, 2008, Moses Runs Against, age 24, of Manderson, was sentenced by U.S. District Judge Andrew W. Bogue to 57 months imprisonment, three years supervised release, and ordered to pay $100 to the Victim's Assistance Fund. Runs Against was originally indicted by a federal grand jury in July 2007 for operating a motor vehicle under the influence of alcohol and assault resulting in serious bodily injury following an investigation conducted by the FBI. The charges stem from an incident that occurred on March 25, 2007, near Porcupine, when Runs Against was driving a motor vehicle under the influence and crashed the vehicle resulting in injuries to the passengers. One of the passengers was a three-year old child who suffered serious injuries requiring surgery at the Rapid City Regional Hospital. On October 11, 2007, Runs Against pled guilty to assault resulting in serious bodily injury. This case was prosecuted by Assistant United States Attorney Gregg S. Peterman.
