Five Men Indicted in Pine Ridge Drug Conspiracy

Acting United States Attorney Dennis R. Holmes announced that five men have been indicted by a federal grand jury for conspiring to distribute cocaine and marijuana on the Pine Ridge Indian Reservation and well as for possessing and distributing it. Will Tymes (age 34), Guy Yellow Boy (age 40), Matt Tobacco (age 21), Bervin Brings Plenty (age 40), all from Pine Ridge, and Merril Catches (age 39), from Rapid City, were indicted by a federal grand jury on August 25, 2009, for conspiracy to distribute a controlled substance (all defendants), distribution of a controlled substance (Catches, Tobacco, and Brings Plenty) and possession with intent to distribute a controlled substance (Yellow Boy and Tymes). They appeared before US Magistrate Judge Veronica L. Duffy on September 16, 2009, and pled not guilty to the indictment. The penalty upon conviction of all counts is 20 years up to life imprisonment and/or a $4,000,000 fine. The charges are merely accusations and all defendants are presumed innocent until and unless proven guilty. The investigation is being conducted by the FBI, ATF, OST and BIA. Assistant US Attorney Mark A. Vargo is prosecuting the case. All defendants were remanded to the custody of the US Marshal. A trial date has not yet been set
